Trimble shooting not presented to grand jury

When the Dyer County Grand Jury released the list of 53 people indicted on criminal charges during its February term earlier this week the greatest interest involved a missing name.

No indictment was returned for Trimble policeman Robert Horner, who shot Stanley Cook beside Trimble's city hall on Dec. 10.

District Attorney General Phil Bivens said no case involving the shooting was presented to grand jurors.

"There is a prosecutor pro tem appointed in that case and I am not involved in presenting anything about it to the grand jury, but if it had been presented I would know about it," he said Wednesday afternoon. Prosecutor Pro Tem Jerry Harris of Shelby County did not return a phone call to the State Gazette Wednesday.

The case, as is standard procedure in any shooting involving a police officer, is being investigated by the Tennessee Bureau of Investigation.

John Mehr, the special agent in charge of the Jackson office of the Tennessee Bureau of Investigation, said Wednesday there has been no conclusion to the investigation yet.

"We don't have a time frame for concluding the investigation right now," he said. "We're waiting on some things and don't know when they will come in, so we can't give an estimate on when our investigation will be complete."

Mehr gave no hint as to what is holding up the investigation.

The delay is causing frustration and understandable concern on the part of Stanley Cook's family, who say they want answers about the killing.

Trimble officials say they have been asked by the TBI to make no statements that could impede the investigation.

Horner, 52, shot and killed Stanley Cook, 35, Dec. 10 on the south side of the town's city hall.

According to witnesses and law enforcement personnel, Horner fired several rounds into Cook's parked car. Cook was sitting in the front seat of the gray sedan with the window rolled down when he was killed.

Horner remains on administrative leave with pay pending the outcome of the investigation.

Those indicted by the February term of the grand jury are:
