Phyllis D. Vaughn, 57, 711 Wendell Ave., was charged with theft of property in excess of $10,000. She and her husband, Charles Norman Vaughn Sr., were in charge of a fund to benefit their grandson, Odell Terry, a teen-aged cystic fibrosis patient.
Although the Vaughns claimed the money has been accounted for, Phyllis Vaughn said Monday that it was in her best interest to enter a guilty plea. In an agreement with the state, Vaughn was placed on judicial diversion, which involves three years of supervised probation and payment of the restitution, court costs and probation supervision fees.
In exchange for Phyllis Vaughn's plea, District Attorney General Phil Bivens announced that he would not prosecute an identical charge against Charles Vaughn, 64.
A hearing to determine the amount of restitution pitted one side of the family against the other. Odell's mother, Lana Terry, tried to convince the judge that her father and stepmother had mishandled the funds. Phyllis Vaughn testified that she'd withdrawn thousands of dollars from the bank account and hidden it in a drawer to keep it safe from Lana Terry. Audience members hurled allegations during a court recess and, in muttered voices declared some of the witnesses "liars."
Judge William B. Acree Jr. of Obion County, who has been handling the case since Judge Lee Moore recused himself, expressed dismay with the testimony, the sloppy accounting procedures and the entire situation. He said neither party had enough credibility with the court.
"I'm not satisfied with any of the players in this lawsuit," the judge said.
The money
More than $33,000 was generated through fund-raisers and deposited into the Odell Terry fund at the former First Tennessee Bank in Dyersburg.
Some of the money was disbursed in checks to specific businesses, and was not questioned.
Lt. Billy Williams of the Dyersburg Police Department's criminal investigations division said he focused on the 16 checks written to Charles Vaughn for a total of $20,950 and the nine checks written to "cash" for a total of $4,290.
Williams said Charles Vaughn referred questions about the checks to his wife. Phyllis Vaughn told Williams that some of the checks were personal loans and that they had all been repaid. But, he said he found no evidence that the loans had been repaid.
Phyllis Vaughn testified Monday that she "didn't put (the funds) back per se in that account." She said the "loans" weren't really loans, but she didn't know what to call them. She said she simply withdrew the money and placed it in a drawer. When Lana Terry needed money, it was retrieved from the drawer.
"There was no really scheme about it," Phyllis Vaughn testified. "I was just trying to put some (money) back all along because I knew it was going to disappear."
Phyllis Vaughn said her husband was so close to his daughter, Lana Terry, that she feared he would capitulate to all of Lana's requests. She said the withdrawals were made to protect the money from Lana Terry, despite the fact that Phyllis and Charles Vaughn were the only persons allowed to make withdrawals.
Phyllis Vaughn said she wrote and endorsed the checks made out to her husband and to cash.
Eventually, the account balance shriveled enough that the bank began charging a $12.50 monthly service fee. Bivens said the service fees eventually claimed $581.50.
After a Dyer County grand jury indicted the Vaughns for theft in December 2005, they placed $5,000 in a trust at the Gates Banking and Trust Co. Both Charles and Phyllis Vaughn said the $5,000 represented the money left in the account and their drawer when Lana Terry contacted the police in 2005.
Lana Terry said she didn't know how much money was in the account or how much had been spent until she tried to buy furniture. The family had returned from a five-month visit in St. Louis and needed to buy furniture for Odell. Terry said she understood the money had been placed in her personal checking account and she purchased the furniture. When her check bounced, Terry confronted her father and learned that the transplant fund was almost empty. Terry said her father and stepmother refused to let her see the bank statements.
Terry reported the situation to the police.
Lana Terry acknowledged that her father gave her cash for trips to the Children's Hospital in St. Louis, Mo. She didn't keep records of how much money she received or spent, so she estimated the totals.
Terry said Charles Vaughn gave her $1,500 for the first weeklong trip in November 2001; another $1,500 to cover 10 two-day trips to St. Louis in the following seven months; $1,000 to help the family move home from St. Louis in February 2005; $150 for another two-day trip to St. Louis in March 2005; $3,000 for appliances; and $6,000 for furniture. The grand total: $13,150.
Bivens noted that the estimated total spent is $12,090 less than amount withdrawn through checks written to Charles Vaughn or to "cash."
Neither Charles nor Phyllis Vaughn kept written records of the money given to Terry. So, they also attempted to compile an estimate. Their listing showed $10,500 for medical trips to St. Louis and Memphis; $6,200 for furniture; and $3,000 for appliances. The grand total: $29,700, or $4,460 more than the Vaughns allegedly withdrew from the account.
Terry said she didn't receive money from her father for trips to Memphis. Her mother, Lawanda Vaughn of Dyersburg, said she drove Lana and Odell Terry to Le Bonheur Children's Medical Center and often bought their meals. If they needed to stay overnight in Memphis, Lana Terry slept in her son's hospital room, Terry and Lawanda Vaughn testified.
The Vaughns' attorney, Edward Chandler of Mountain Home, Ark., later asserted that Lana Terry had received money for her trips to Memphis and merely pocketed the funds.
Accusations abound
Chandler repeatedly attempted to discredit Terry's testimony. In his opening statement and cross-examination, Chandler accused Terry of income tax fraud, food stamp fraud and drug abuse.
Terry addressed the allegations in her testimony.
Unable to work and divorced, Terry said she allowed Lawanda Vaughn to claim Odell Terry as a dependent on her income tax return one year. Vaughn received a larger refund and shared it with her daughter.
Lawanda Vaughn said she paid many of the family's bills and provided many things for Odell Terry. Vaughn said the Internal Revenue Service audited her return and had reported no problems.
Terry said she was receiving food stamp assistance in Tennessee and had some money still available on her assistance card when the family moved to St. Louis in 2004. Terry said her mother used the card to purchase groceries in Dyersburg and brought the groceries to the family in St. Louis.
Terry said she was initially approved for food stamps in St. Louis, but the assistance stopped when the state decided that her housing situation was not permanent. The family was living in Ronald McDonald House apartments made available to persons receiving medical care, she said.
Chandler asked Terry if she remembered writing a bad check for $1,500 worth of crack cocaine. Terry testified that she had been addicted to crack cocaine but she'd completed rehab and was no longer using drugs. After the court hearing, Terry said the incident to which Chandler referred happened 14 years ago and she was never charged with a crime.
Chandler also questioned a number of witnesses, including Terry, about another bank account set up for Odell Terry's benefit at Security Bank in Trimble. The money was to be used for rent at the Ronald McDonald apartments in St. Louis.
Terry said she paid $25 a night for the apartment while Odell was waiting for a double lung transplant. He never received the transplant; he is currently getting good results from an experimental medication, she said during a break in the hearing.
Bank Manager Chasity Norville said Terry wanted to anonymously pay the rent herself. Norville said she called the Ronald McDonald House's toll-free phone number and was told that families don't pay rent to live in the Ronald McDonald House. Norville reported that to Terry's mother and her brother-in-law; the trio who oversaw the Security Bank account.
Terry agreed that families are required to pay to stay in the Ronald McDonald House, but they are assessed a fee to stay in the long-term apartments. She said she paid the rent and had proof of that until her home south of Dyersburg burned on Feb. 13.
Norville said the Security Bank account was closed and the $2,200 balance turned over to Terry.
In his opening statement, Chandler pointed to the confusion over the rent money as proof that Terry was stealing money from her son's accounts. "If she would take this money (from Security Bank) and deny it, she would take this money (from the First Tennessee account) and deny it," Chandler argued.
Norville said she also refused to cash a $1,500 check from a fraternity at an Arkansas college. The check was made out to the Odell Terry transplant fund. Norville said Terry attempted to cash the check. Norville said she couldn't do that because it was an out-of-town check and because it was written to the transplant fund, not to Terry.
The outcome
In his closing remarks, Chandler told Judge Acree that the whole case hinges on the question of who to believe: the Vaughns or Lana Terry.
The judge interrupted him.
"I just told you a minute ago I don't believe either one of them," Acree said. He pointed to Terry's attempt to cash the Arkansas fraternity check, Phyllis Vaughn's decision to hide money in a drawer and Charles Vaughn's lack of credibility in the courtroom.
Chandler said his accounting shows all of the money passing through the First Tennessee account has been used for Odell Terry's benefit. He said the Vaughns owe nothing.
Acree retired to the judge's chambers to sort through the records and consider his opinion. He briefly conferred with Bivens and Chandler and 35 minutes later emerged.
Chandler said he was "extremely disappointed in the manner this (fund) was handled by his mother and his grandparents." Acree said he believed the purchase of furniture and appliances was inappropriate, even if they were used in the boy's home. He said he didn't understand why the transactions were made in cash and why no one kept records.
Acree said he doubted that either side really knew how much money had been spent.
He said the Vaughns removed $25,245 from the fund and, making an adjustment for the dispute over expenditures, said the Vaughns owe $10,950 in restitution. He said $5,000 is to be deposited immediately, referring to the $5,000 now in a trust in the Gates bank.
The rest of the restitution, as well as the court costs and probation fees, are to be paid in monthly installments during the next three years. The funds will be held in a trust by the Circuit Court Clerk's office.
Acree warned Phyllis Vaughn that if she failed to pay the funds or violated the terms of her probation, she would be brought back to court and a new sentencing hearing held.
Acree also told Vaughn that if she had not already made a deal with the district attorney, he never would have placed her on judicial diversion.

There are two Phyllis/Phyliss Vaughns in Dyer County. Phyllis Vaughn was the one refered to in the article, not Phyliss Vaughn. Your attacks are pretty personal, so stop hiding behind your username! (MAJORITYRULES) They ARE nice grandarents! They were actually AT the fundraisers for Odell Terry. They raised the money!!! Where was Lana? The money was put in a drawer by Phyllis to keep the money safe from Lana, because she wanted to buy a house with the money! Lana was the one that pleaded for money to get appliances and furniture for her and Odell's house. She recieved a CAR and got dental surgery with the money. Phyllis and Charles are two of the best people I know. They actually had jobs (retired) and sometimes did without so that their children had everything that they wanted. The county mayor (Richard Hill), a physcologist, a bank manager, and a bank president all testified who was truthfull. (The grandparents)
Do you ever wonder why people are quick to judge Charles and Phyllis Vaughn, but yet Lana Terry spent 2,000 from an account for Odell. What did that money pay for?

As the Judge stated: neither party is credible. Maybe the Vaughns are good people, but they should have kept precise records of every penny spent, and no money hidden in a dresser drawer...that's ridiculous. So very sad for Odell with his family fighting about money.
I agree the money IS for Odell! But the people in Dyersburg should know a few things before they sit back and decide to pass judgement. First of all, I am sure that any person that ever gratefully donated to the Odell Terry Transplant Fund thought that their hard earned money was being donated to help pay for medical expenses, but that's not where it went. A lot of people in this town have had more than a few things to say about Charles and Phyllis Vaughn, yet no one has bothered to ask Lana Terry why she spent this money to buy furniture, appliances, a car, and to pay for her own dental bills. You could basically say that the citizens of Dyer County provided Lana and her husband Rodney with a very comfortable life style. And speaking of Lana's husband, has anyone but me asked themselves why he couldn't get out and get a job to pay for all these things, and has anyone but me wondered why he never appeared at any of the court dates or why he never had the first thing to say about all of this. As far as I can tell neither one of Odell's parents have worked. I do think that mistakes have been made and the book keeping could have surely been better, but I think Lana and Rodney should be held accountable for their part in all of this. It is a known fact to many that they are both "recovering" drug addicts and I have been told that Rodney has a drinking problem. I just want people to sit and ask theirselves, if neither one of them worked how did they afford to buy cigarettes and beer. How did they afford to buy anything. And finally I hope that the people of Dyer County realize that a lot of this money is gone and yet Odell still has not had his transplant, and when the time comes for the transplant to happen I wonder how the furniture, appliances, and the car that Lana spent the money on are going to help pay medical and travel expenses for Odell. Just remember before you pass judgement, make sure you know the WHOLE!!! story

It is very interesting to me, that so many have opinions on this matter, as I feel that this particular article really doesn't tell the whole story. It is strange to me that this child's mother managed to get people to donate for an ORGAN transplant that has never occurred. Was a transplant truly needed? Or was this a creative way to raise funds for someone who doesn't appear to work and evidently has a history of drug abuse, according to this "fine" one sided paper. People in glass houses shouldn't throw stones, so maybe you better make sure that you are living right.
I will be the FIRST person to actually use my real name to post a comment on this situation. People should not be able to say such hateful things about either side until they are willing to be an adult and post their real names.
I was/am related to this family and it breaks my heart to see money tear apart such a (use to be) loving family. I have known all of them for about 14 years now and can say that neither side can stand up and say that they have never done things that they regret or wish that they could change. WHO COULD??? I do know that Lana does love her children and YES she has made some bad decisions and choices in her lifetime, but shouldn't you forgive a person and at least let them try to fix their mistakes??? How would everyone on this comment list like to have something from his or her past pulled up years later and be judged for it?? I know I wouldn't.
I think that when this money was decided to be handled by Charles and Phyllis it was the right decision at the time. Now here we are YEARS later and it is nothing but the Devil trying to break apart a family. Everyone gets into finiancial trouble at times and it may have been too tempting for Phyllis to "borrow" this money from his account to pay personal things off and never get around to paying it back. Money goes very fast as EVERYONE knows and it is hard to know where EVERY dime goes.
As far as the money spent on home furniture and appliances for Lana's house - shouldn't she be entitled to that money?? She has to provide a couch to sit on, a table to eat at and a bed to sleep in for Odell! And don't you think it is a little hard to hold a job when your child has to be seen after at all times and you have to travel with your child to doctors visits almost every week? I do think that Odell's father should step up and try to do better than what he does for his family, but I also know lots of fathers who don't work or support their children like they should. Maybe they should write a newspaper article on that!
All I know is Odell won't be here forever. His life expectancy is only about 30 years. Money isn't the important thing - HE IS! All of these family members (and people that posted comments) should see that and try to enjoy and cherish loved ones while they are here. Life is too short. We shouldn't judge anyone for their mistakes - they will be judged by GOD!

Catherine I totally agree with everything you said, and you are right about most of the things you said, but the only point that I would like to make that you didn't is that when this all started Phyllis and Charles were seen as aweful people that stole all their grandsons transplant money and that is not the case. They were NEVER given the benefit of doubt. You may know as I do that they are good people but not every body knows them as we do. In your comment you made the statement that Lana had made some bad decisions in her life but that she should be forgiven or be given the chance to try and fix them. Well guess what, NO ONE !!! gave Phyllis and Charles that option either. They are not perfect by any means, but neither is anybody else. No matter what they did or DIDN'T do they should be given the same respect. The fact is, there is not one person in their family that has not suffered because of this whole ordeal and now that it is over each one of them have to try and pick up and move on with life. There are children as well as grandchildren that may forgive but they will never forget! I am very close with this family and in my opinion Lana received all the money that charles and Phyllis say they gave her, but no matter if they did or didn't there are people in Dyerburg that believe that they are horrible people and because of this their reputation is ruined forever, and that is something that can never be fixed. I just hope and pray that God can help them and the rest of the family through this. One last thing I wonder do some of these judgemental people ever think about what this has done to Phyllis' mother, she is 85 years old and this has been VERY HARD for her, and at her age, she shouldn't have to deal with things like this.
Maybe they used the money to travel back and forth to church 7 days a week since they really needed to go, but obviously, forgot to listen to the sermon.
I would just like to say that I am Charles Vaughn's other daughter and Lana's sister. I have tried to stay out of all of this mess since the start of it. All that I can say is that this has torn my whole family apart. If you look at this situation with the natural eyes you would believe that it can never be put back together. I; however; believe that with God all things are possible. It is very easy to hide behind screen names and say very hurtful things. You just remember the next time that you make a hurtful comment that you are saying it about someone that is loved by someone. I love everybody involved in this. I have tried to reassure both sides that I love them with everything I have. I only know 2 of the people that have made statements on this blog. Catherine and Matt. I appreciate the comment left by Catherine. I felt like she was fair to both sides. I would like Matt to know that no matter what has happened that the Terry's are STILL your family and most diffently are mine. How can this heal if no one is willing to let it go. It has been 3 LONG YEARS!!!!! When is enough, enough? Yes there are things that were said that did not make sense to some and even to me, but guess what? When you have a child in need like Lana did and like Dad did; who is going to be thinking about records that might be used in court? I know if either of my boys needed something I would make sure it was gotten without question. I would like to say that I did not agree with the way this was handled and it sure has left a big mess with wave upon wave of collateral damage. So instead of kicking people when they are down, how about using a little compassion? Thank you! Just a side note for the ones that don't know about Odell. They tried using Zyvox, an antibiotic, on him and it caused him to become healthier. The transplant team in St. Louis said, "it would be unethical to transplant him now. In the 15 plus years I (the surgeon) has been here (at Children's Hospital) I have never sent a child home without getting transplanted, healthier than when they started." So yes Odell was on the active list and taken off the "active" list for now. He is still on the list as inactive at this time. He is doing great as far as his health is concerned. I would like to thank everyone that gave to the Odell Terry Transplant Fund. Your heart was in the right place. We worked very hard to do this for him because we love him.
This is Lana Terry and I just wanted to give time for things to calm down before I even checked this site. I understand there are things that have been said and read that people do not want to understand or that they can not understand. All that I know to say is that God chose me and Rodney to give a special needs child to not anyone else in my family. That makes us special parents. They do not come with a handbook or instructions. We have done the best we could by both our children. It is NOT for ANYONE to tell me if I am a bad parent or that I have done something wrong. We have had to rely on opinions and experiences of other families that have gone through what we are going through. It is no ones place to tell me that I am not doing it right because there has been LOTS of times I sat in the hospital alone with no one with me from my family. Kind of easy to sit at home and tell us how to do with our terminal child. I wish I could change places. Who knows maybe I would of done better on the sidelines.

Lana I don't think anyone ever said you were a bad mother, but neither is mine. Unfortunately she wasn't given a chance from the start. But as usual she made it through just like she always has and always will. People who know her, know the truth and those who have lied on her and those who don't believe her, Who cares what they think. My mom is a special person who has been through a lot herself and what hasn't killed her has only made her a better person. She is not perfect by any means but she is my mom and I will defend her and stand behind her to anyone or anything. Now that all this mess is over we can finally move on.
