Public defender services revoked in child abuse case

The man accused of aggravated child abuse was released from the Dyer County Jail on Monday after posting a $25,000 bond.

Joseph D. "Binks" Lee, 36, 313 Williams Dr., Dyersburg, was arrested on Friday after police investigators found he had assaulted a 12-year-old relative.

A State Gazette article on the arrest in Monday's edition incorrectly noted he was arrested as a suspect in the child abuse of a 15-month old child. That case, from November 2007, was never pursued, records indicate.

Binks appeared in Dyersburg City Court on Monday, where prosecutor Jim Horner asked Judge Dean Dedmon for a $35,000 bond. Assistant Public Defender Patrick McGill said he favored a $2,500 bond due to the crime's status as a Class E felony.

The prosecution conferred with police investigators and investigators from the Tennessee Department of Childrens Services while Lee appeared in court.

McGill's services were denied by Dedmon after Lee, who was in possession of $1,600 cash when he was arrested, said he would be able to make the $2,500 bond.

Lee exited the jail at 5:30 p.m., records note.

Lee was also given a no contact order for the address where the event was reported.

A hold against Lee from Illinois was dropped on Monday after a Massac County, Ill. investigator faxed a release to the Dyersburg Police Department explaining Lee's brother, Flavious, was the one who was wanted and not Joseph. Flavious had used Joseph's identity when he was arrested in Illinois, the fax said, which resulted in the mistaken hold warrant.

Joseph Lee's next court appearance was scheduled for April 28.

I wish Binks the best. I grew up with him and flav. As kids flav was the choir boy. Everyones older brothers and other relatives use to keep us all in line. I think this may blown up a little.

Innocent people don't use other peoples identity when confronted by the police .Nice brother.

I would like to say in America we are innocent until proven gulity.Unless you where there you cant say what happened.I know the State Gazette was there because they reported the story as a 15 month old baby.Everyone is so quick to point the finger at Binks before they hear what really happened.I dont see any of you all talking about your beloved Doctor Cole..Maybe we forgot he was charged with anything.Hummm.I grew up in Dyersburg but moved far away.I can see things still havent changed.Everything is still black and white...Blacks are guilty before they stand before a judge and whites are innocent until they get caught red handed,or on a live video...Sad to say but its true...Lets see the evidence and the other side before we pass judgement...
