Reed amends $2.5 million suit against city mayor, aldermen

The former Dyersburg city treasurer who filed suit in October 2006 over his dismissal amended his $2.56 million complaint last week to clarify his case.

The move on May 28 by Robert Reed led to the decision by U.S. District Judge Bernice Donald on Monday to deny the city's motion for dismissal.

Reed altered his original complaint to detail his allegation of age discrimination stemmed from violations of the U.S. Constitution and Tennessee Human Rights Act. He is seeking compensatory damages of $280,000 under federal and state law; $280,000 in compensatory damages under only federal law; and $2 million in punitive damages under federal law.

His previous complaint did not split the state and federal questions.

The city had filed a motion to dismiss the case on March 21; Reed filed his amended complaint on April 30.

The judge's order said the city's motion to dismiss became moot since the new Reed filing.

Defendants in the Reed civil action include Mayor John Holden and the board of alderman as individuals.

Reed, 62, was city treasurer from September 1988 until Jan. 22, 2007. He alleges he was fired by Holden for being a supporter of former mayor Bill Revell.

Reed cites age discrimination in the hiring of current city treasurer Steve Anderson, who is called in the complaint "substantially younger" and who "did not meet the minimum qualifications for the position of city treasurer."

Vanity5, whom do you think makes up the City of Dyersburg? Not the elected officials, but the citizens that live and work here; we are all being sued you fool! Unfortunately, if your wishes do come true, it won't be the elected officials that will suffer the most, it will be the citizens that will bare the brunt of the settlement costs. Obviously, your general lack of education pertaining to government policies and regulations provides great entertainment, but yet, grave concern for those of us who "truly" understand the ramifications of this outlandish lawsuit.

We are in recession now and yall are talking about paying this type of money. D'burg should go in debt if this falls through. I am glad to see someone stand up and quit letting certain people with power and money to make decision and try to run D'burg. I hope he suceeds and make them all pay. It is not know telling who mayor holden pushed and shoved out for his reasons. Well Baltimore, I know you are leaving but I knew it wouldn't be long. I bet they get another person of color in there for show. Or do Mayor Holden have someone picked out for this job too. I heard he has someone from his church picked out for it already. This is still a white person town and will always be, so be it.

Mr. Reed was a political appointee,,,,,,,,, he served at the pleasure of the mayor.... he was not in the civil service...... he lost the election.......... he should quit whining and move on...... he gives public servants a bad name............

Mayor Holden better be cleaning out his desk

and putting his personal property in someone else's name.Better yet,he better get

the city attorney to approach Mr. reed about

settling out of court.If not,Dyersburg could

become Reed burg!

I would like to know what the qualifications are for alot of the cities positions where people are paid $70,000 to $85,000 to drive around town and make people think that they are important. I'm not gonna call any names but there are several people in office right now that couldn't make a peanut butter and jelly sandwich...much less have the ability to bring forth any form of information that could contribute to improving this town. I'm sorry if I have offended anyone, but that type of money deserves some form of justification and accountability to the public.
