Teen linked to robbery, murder pleads to one charge

An 18-year-old connected to a murder and attempted robbery pleaded guilty Dec. 2 to one of the charges in Dyer County Circuit Court.

Keaston Danterrain Tipton of 919 Custer Ave., pleaded guilty to conspiracy to commit aggravated robbery. The first-degree murder charge was dismissed.

Tipton was accused of conspiring to rob a man at the Sunrise Inn on May 4. The would-be robbers went to the wrong room; Karl Maurice Franklin, 42, of Gardendale, Ala., was fatally shot in the botched robbery.

Tipton was sentenced to six years in prison.

Two co-defendants - Darius Brown of Rivers Street and Wilmon "Sonny" Moses III, 32, of Highway 79 in Ridgley - are scheduled to appear Feb. 17. Both men are charged in the conspiracy but only Brown remains charged with first-degree murder.

In other circuit court action during the first week of December:

* David F. Henning, 46, 1207 Hornbrook St., was sentenced to 15 years in prison. A jury found him guilty of simple possession of cocaine and tampering with evidence on Sept. 25. A related charge of resisting arrest was dismissed.

Henning was fined $750 and sentenced to 11 months, 29 days in jail on the cocaine charge.

He was fined $750 and sentenced to 15 years in prison on the tampering charge. The sentences are to be served concurrently with each other, but consecutively to a previous sentence.

* Edward Earl Copeland III, 22, 941 Bonicord Road, pleaded guilty to two counts of aggravated burglary and burglary of an automobile. Additional charges of failure to appear, theft of property in excess of $1,000, and two counts of theft of property less than $500 were dismissed.

On each of the aggravated burglary charges, Copeland was sentenced to concurrent 4.5-year terms in prison. He was ordered to pay $325 restitution to one of the victims. He had been accused of burglarizing two homes on Sept. 9 and taking four shotguns, a rifle and an MP3 player from one of the homes.

On each of the automobile burglaries, Copeland was sentenced to concurrent two-year terms in prison. These sentences are to be served consecutively to the aggravated burglary sentences. He also was ordered to pay $393 restitution to one victim and $23 restitution to the other. Copeland had been accused of burglarizing two vehicles on Aug. 3, taking a Blackberry cell phone and sunglasses from a truck and taking sunglasses and a change purse from a car.

* Angela Marie Pevahouse, 26, 2889 Lovejoy Road in Finley, pleaded guilty to aggravated burglary, forgery, theft of property in excess of $1,000 and failure to appear. Additional charges of aggravated burglary, theft of property less than $500 and forgery were dismissed.

In the burglary and forgery cases, Pevahouse was accused of breaking into a Phillips Street house on Jan 12, 2008, and taking prescription medications, blank checks, a car title and more. Two of the stolen checks were later cashed at Factory Connection and Wal-Mart.

For the aggravated burglary, Pevahouse was sentenced to four years in prison. She was sentenced to a two years in prison on the forgery charge and will serve those terms concurrently. After serving eight months, she will be placed in the drug court program. She also was ordered to pay $716.61 restitution to Factory Connection and $587.53 restitution to Wal-Mart.

For the theft in excess of $1,000, Pevahouse was accused of breaking into a Newbern home and stealing a handgun and prescription medications. She was sentenced to two years in prison and ordered to pay $1,500 restitution to the homeowner. The prison sentence is to be served concurrently with the first two sentences and she is to be placed in the drug court program after serving eight months.

For the failure to appear charge, Pevahouse was sentenced to a year in prison and will serve that sentence consecutively to the other sentences.

* Ronnie Ray Pannell, 52, address unavailable, pleaded guilty to violation of the motor vehicle habitual offender act. He was sentenced to three years in prison as a multiple offender who must serve at least 35 percent of his sentence before being considered for parole.

* Carl Clarke, 19, 408 Pate Ave., pleaded guilty to burglarizing the concession stand in pool area of Dyersburg Activity Center. He was sentenced to three years in prison and ordered to pay $500 restitution to the city of Dyersburg.

* Shane Wilson Mauldin, 33, address unavailable, was sentenced to four years in prison on a charge of theft of property in excess of $1,000. He was accused of claiming an $8,000 load of soybeans as his own on Sept. 16, 2007. His prison sentence was immediately suspended and he was placed on supervised probation.

* Winston Sharp, 56, 554 McClain, pleaded guilty to forgery and was sentenced to four years in a community corrections program. He also was ordered to pay $300 restitution to First State Bank.

* Shane D. Smith, 42, 1451 Hazel Circle, pleaded guilty to assaulting his girlfriend, third offense driving while intoxicated and seventh offense driving with a revoked license. A related charge of evading arrest in a motor vehicle was dismissed.

For each count, Smith was sentenced to six months in jail followed by 11 months, 29 days of supervised probation. The sentences are to be served concurrently.

On the drunken driving charge, Smith was also fined $1,100 and his driver's license was revoked for three years.

On the license charge, Smith was ordered to pay a $500 fine.

* Dana Lynn Biggers, 34, address unavailable, pleaded guilty to a failure to appear charge. She was sentenced to a year in prison and is to serve that sentence consecutively with a previous sentence.

* Three charges of selling more than half a gram of cocaine were not prosecuted against Timothy T. Dewalt, address unavailable.

* Zachary Lynn Garner, address unavailable, was not prosecuted on charges of burglary of a motor vehicle and theft of property in excess of $500. He had been accused of taking a stereo and shoes from a car on Aug. 25, 2007.

* An assault charge was not prosecuted against Michael Troy Sipes, 20, 180 Circle Drive.

well, it's only first degree murder. it's not like he robbed a concession stand or anything

I don't get it! Why did Pevahouse only get 8 months and drug court and Clarke get 3 years. He broke into one place. She's all over Dyer county stealing and passing checks and doing drugs while in the possesion of a firearm. I'm not judging the individuals, but am questioning the vast difference in sentencing. Money talks I guess and for some it speaks loudly.

Let me see third offense driving while intoxicated, SEVENTH NOT SECOND offense of driving on a revoked license . His license was removed for three years .What license ? Do you really believe that will stop him ? AMAZING SIMPLY AMAZING

You gotta love they way the deals are made. What ever happened to justice served. jscott, your right on about the deals. Look at what he did for the teacher that raped that boy in Lake County. You can have to people charged with the same thing and they will get totally different sentences. Who you know or how much money you got will get you a long way around here.

This is what makes you angry when you see a guy like essary die for his country, then you see this punk out there robing and killing, then it's dismissed....all jokes in the corner, this is serious....
