Man accused of assault with baseball bat not prosecuted

In Dyer County Circuit Court on April 27-28:

* Jerry Lee Fortner, 27, 624 Forrest St., was not prosecuted on a charge of assault. He had been accused of hitting a Dyersburg man with a baseball bat on Aug. 2. Fortner was granted pretrial diversion on Dec. 23 and placed on supervised probation for a year. His diversion was terminated in January.

* Michael Shane Hutcheson, 35, 111 S. College St. in Ridgely, pleaded guilty to aggravated burglary. He is accused of breaking into a Finley home on May 15, 2008. A related charge of theft of property in excess of $1,000 was dismissed. He was sentenced to 4.5 years in prison and ordered to pay the victim $1,400 restitution.

* Andrew Blake McAlister, address unavailable, pleaded guilty to aggravated burglary and was granted judicial diversion. He was placed on supervised probation for three years.

* Jessica N. Sturgill, 28, 408 Nebo-Yorkville Road in Newbern, pleaded guilty to theft of property in excess of $500. She was accused of taking $839.25 from cash registers while working at Wal-Mart over a month's time in 2007. She had been placed on pretrial diversion in December 2007, but that was terminated. She was sentenced to two years in prison, with the sentence being suspended immediately. Sturgill was placed on supervised probation for two years. She also was ordered to pay $839.25 restitution to Wal-Mart.
