The man, Steven Ray Thacker, 39, of Chouteau, Okla., is seeking post-conviction relief. He asked the court to overturn his murder conviction and his death sentence.
Retired Judge Allen Wallace of the 23rd Judicial District in Waverly heard testimony Monday, Tuesday and Wednesday. He took the case under advisement Wednesday afternoon and will issue a decision later.
Wallace said post-conviction relief hearings comprise the hardest job for a judge. He must decide if there's a reasonable probability that a case would have been different but for the attorneys' actions.
Circuit Court Judge Lee Moore, who presided over Thacker's 2002 trial in Lake County, recused himself from hearing the request for post-conviction relief.
Thacker was convicted Feb. 8, 2002, on the first-degree murder and felony murder of Dyersburg tow-truck driver Ray Patterson, 52. Patterson answered Thacker's call for assistance Jan. 2, 2000, on Interstate 155. Patterson towed Thacker's stolen car to Patterson Bros. service station. When Thacker's credit card was denied, Thacker stabbed Patterson to death and stole his tow truck, cash, credit cards and an unloaded pistol. Police tracked Thacker to a Union City motel, where he was arrested.
Patterson is one of three persons Thacker killed during a 10-day violent streak that started in Oklahoma and continued in Missouri and Tennessee. He pleaded guilty to kidnapping, raping and killing Laci Dawn Hill, a 25-year-old woman in Bixby, Okla., and to killing restaurant supervisor Forrest Reed Boyd, 24, of Aldrich, Mo. Thacker was sentenced to death in Oklahoma and life without parole in Missouri.
In his request for post-conviction relief in Tennessee, Thacker claims his court-appointed attorneys Charles Kelly and Tom Strawn provided ineffective counsel. The petition claims:
* Kelly, the lead attorney, ignored the preparation for trial. That job fell to the co-counsel.
* Kelly met with Thacker only three times before trial and was unavailable by phone. Attorneys are supposed to establish a working relationship with their clients.
* Kelly failed to use the information and testimony made available by his defense team.
* Kelly failed to develop a sound theory of defense. For example, Thacker suffered from bipolar illness, which possibly could have ruled out first-degree intentional murder.
* Kelly and Strawn failed to prepare for the sentencing phase. The petition claimed the attorneys relied on Thacker's mental illness and abuse and neglect as mitigating factors to reduce the potential sentence. Little evidence of either mitigating factor was presented. The petition also said a mitigation specialist had prepared a list of 21 possible mitigation themes to be explored, developed and presented six months before the trial. None of the mitigation themes were pursued.
* The attorneys bungled the jury selection.
* The attorneys failed to talk to their witnesses before trial and, as a result, did not ask the questions necessary to provide evidence to help Thacker's defense.
* The attorneys failed to have Thacker tested by a neuropsychologist, as recommended. He reportedly suffered brain injuries from a fall on his head at the age of 1 and from a serious motor vehicle wreck.
* The attorneys did not use information showing how Thacker's illness and life events had caused his life to crumble or how the prison had allowed him to rebuild stability in his life, making him a good candidate for a life sentence.
* The attorneys failed to object to improper jury instructions; failed to devote adequate time, attention and effort to the case; and failed to obtain the required knowledge and skill for capital cases.
* The attorneys should have pursued Thacker's "diminished capacity" defense. The petition said Thacker's mental state at the time of the murder was the key issue during the trial. Instead of pursuing that idea, the defense attorneys settled for a claim of self-defense but failed to provide evidence of self-defense.
* The attorneys failed to file or challenge pre-trial motions and, after his conviction, failed to raise key issues in a motion for a new trial.
* The trial court erred in its instructions to the jurors.
* The death penalty violates Thacker's right to life, is unconstitutional, constitutes cruel and unusual punishment, and violates the idea of equal protection.
Donald E. Dawson, a state-employed post-conviction defender, represented Thacker during the hearing.
To support the conviction and sentencing of Thacker, District Attorney General Phil Bivens was in the odd position of defending Thacker's defense attorneys. Thacker was faced with overwhelming proof that he'd killed Patterson. The chances of a "not guilty" verdict were slim to none, Bivens told the judge in his final argument Wednesday afternoon.
Thacker refused a plea bargain that would have given him a life sentence because he wanted certain guarantees that no one could give him, Bivens said. Thacker reportedly told Kelly that he wanted the death penalty.
Bivens said Kelly relied on a psychological evaluation indicating an insanity defense was not feasible. Instead, Kelly resorted to a self-defense argument, which he doubted would work, Bivens said.
Bivens acknowledged that Kelly and Strawn did not use all of their peremptory challenges while selecting the jury. But, he said he didn't consider that a failure. He said the defense team used a jury selection expert and they may have decided that the persons seated on the jury were a better option that those still remaining in the jury pool. Bivens said that is a legitimate trail tactic.
Thacker is currently being housed in the Riverbend Maximum Security Institution in Nashville.
Thacker also sought post-conviction relief in the Oklahoma case. Dawson said his request was denied.

Post-conviction relief,my butt! If anything,he should be put to death! Ray Patterson was a great man,a humble man,who went to work each day and did all he could to help his fellow man.The entire Patterson family is like that. And the scum has the nerve to ask for his conviction to be overturned? I wonder if he was thinking that as he murdered Ray? I hate to say it but Thacker should have been dead about eight years ago.The basta*d sure has some nerve! I guess the jail house lawyers encouraged him a bit but,but I'm afraid he's in for a big disappointment! I would gladly volunteer to put the needle in his arm!
Where is the relief for Mr. Patterson or his family? Where were his judge, jury, and attorney? Mr. Thacker gave Mr. Patterson, an innocent person, a death sentence. So why shouldn't he, a convicted murderer, get the same? He isn't denying he did it. He just doesn't want to die for it. I don't think he should have the right to decide what happens to him after being convicted. I believe an eye for an eye. I know I am going to hear a lot of blah blah Mr. Thacker is a sick person...but say he goes to a treatment facility for a couple of years or even a decade. He gets all the right meds and counseling. He is released because they feel he is no longer a danger to society. He later decides he doesn't feel like he is sick anymore and stops taking his meds. He runs into a loved one of yours (any reader put yourself here). He kills your loved one. I believe you may have a different opinion after the tragedy is yours.
Are you serious right now? I have known the Patterson family for most of my life, haven't they suffered enough, they have been through h*** and back!!! The only thing wrong with Thacker is that he is a KILLER!!!, don't cry MENTAL ILLNESS, thats what most killers do!!! Over turning this sentence is SO wrong, it shouldn't even be considered, Thacker killed a very good outstanding citizen, husband, father, brother, and grandfather. Love you A!!!

Why is it that everytime a low life scum gets close to the time of death it is then they start crying I was sick I didnt know what I was doing. Did he give Mr.Ray that chance NO he did not he cold calulated killed a wonderful man who did nothing to him but help him.The Pattersons are good people and Ray would help you no matter what His family does not deserve this grief. All I can say is Thacker you should have been put to death a long time ago or it would have been best if you had never been born. Tell your jail house lawyers to get somewhere and stop using my tax money to pay for them.
People, people, people. Don't be so cruel, and heartless. We all need to get together and pray for his release. Reading all the reasons he feels that he didn't get a fair trial should serve to establish that he didn't mean to do what everybody thinks he did.
However, I also think that when he's released, the people at the front of the crowd, should be the families of the people he killed. Allow them to dispense justice, in whatever manner they see fit. If something were to happen that he died, then get ready for the big parade!
Or, they could just turn him over to the dude that starved the dog that was in the paper not long ago. That might even be better!!!
I grew up in Dyersburg and know the Patterson family. I have lived in Tulsa, Oklahoma for many, many years. If something happens and you are not able to execute this guy, send him back to Oklahoma. We will take care of this problem! Interesting that so many say that the death penalty is not a deterrent, but these guys fight it so hard.
i never had the pleasure of meeting the patterson
family.but i strongly believe that the judical system is messed up.i strongly believe a eye for eye ,tooth for tooth.acroos the country the cut your hand off for stealing on the spot.they believe in the same .murder is murder.and to overturn his conviction is WRONG/////to the family it would be like killing mr patterson all over again .may god be with them now

ExPat you are part of the problem!! You say "no crime is so bad that our legal system should be circumvented"...tell me genius, why is it NOW he it trying to get this overthrown. He was tried, convicted, and sentenced. He went through the legal system. Our system should not be weighed down with crap like this. Do you realize the amount of money that is wasted on these pathetic excuses for human beings? Hundreds of thousands of dollars of our tax money each year goes to educate, feed, and house these inmates. For what? To delay the inevitable fate? Ex-Pat I noticed that as well. I believe they corrected the article but they didn't issue a retraction. Something most newspapers do when they make an error. Unfortunatly they must have felt by making the correction justified enfriendging (sp) on the readers free speech by deleting the comments. Sad thing is it was out there for so long everyone saw it now they would have us believe it never happen. How can we trust their reporting if they fail to issue a retraction when they are in error.
Uncle Ray was a really great man. Thacker doesnt deserve a chance to live. those of you who is teeling everyone that we shouldnt be so cruel, put yourselves in our shoes. He was murdered by a cold hearted person, who didnt even know him. i think we have every right to be angry toward him. He was convicted and he didnt like what he got.

Charles Kelly is the best lawyer Dyersburg has ever had. He desreved Noel "skip" Riley!!! Then, he would have had a reason to be whinning about a sucky lawyer. But, then again, it's people like you that make these assinine laws, anyway.

To ExPatDyersburgian, I am an immediate family member of Ray. Steven Thacker is NOT innocent and his counsel was competent. In part of his statement or confession to the police he was aked to describe a certain event. He had pleaded self defense. In his own words!!! After he presented Ray with a credit card that he stole from the gentleman he killed the day before. There was a warning that came across the credit machine, he said. " I knew he wouldn't give me back the credit card.. I knew I was wanted in two other states, so I stabbed him. Ray pulled out his gun and I ran into the service area behind one of the cars because I thought he would shoot me." Please do not think this monster is innocent.How does self defense play apart in this case?? I agree with you, that there are innocent men and women in prison and yes some has had bad counsel, but this is not the case. Ok, he says he is sick with Bipolar. That may be so, but it was in his own words that he didn't like taking his medicine and I quote. "I didn't like how it slowed me down." He knew what he was doing. I do not feel sorry for him one bit and if he doesn't repent to God, he is condemned in this life and the next.

If that young lady in Bixby, and/or the young man in Missouri had have had a gun, and knew how to use it, this case may very well have never existed. That is why I believe that, from the fourth grade through high school, children should BE REQUIRED to bring guns to school, so they can be taught gun saftey.
