Code enforcement issues certified letters to property owners responsible for dilapidated state of Mall Loop Rd.

Since early 2018, many Dyer County residents have found themselves darting around two noticeably large potholes located on Mall Loop Road, near exit driveways of Taco Bell and Arby’s, a property which is owned by Action Properties, a company based out of Yazoo City, Miss. -- the same company which also owns the Dyersburg Mall.

The Mall Loop potholes have become somewhat locally renowned over the years, evolving into flower beds and even, one year, a fishing hole. While the City of Dyersburg has received some backlash over Mall Loop Rd. over the years, the property is owned and managed by the same company that owns the Dyersburg Mall—Action Properties.

While the City of Dyersburg is not directly responsible for the damaged roadway, residents have made inquiries regarding the responsibility of the City to enforce safe standards.

In an interview with City of Dyersburg Code Enforcement Inspector Thomas Mullins, he informed the State Gazette that Code Enforcement made multiple unsuccessful attempts to communicate with Action Properties before issuing a certified letter to the business’ home office in Yazoo City last September. Mullins says portions of the road were then repaired, however, the portion located near the entrance to Arby’s was left in a dilapidated state.

Mullins says he was not made aware of the need for additional repairs until this week. The notice follows a post published by the State Gazette on its Facebook page regarding the disrepair of the road. Mullins says another certified letter has been issued. Action Properties will have 10 days to respond with a course of action. If they fail to comply or respond, they will face a citation and court order.


With the recent acquisition of a portion of the Mall property by Waffle House, Mullins says the entranceway to Mall Loop Road is now co-owned by Waffle House. A separate certified letter will also be sent to them this week.

  • Who sends certified letters for the potholes on property that the city owns? And if Action Properties sends a letter back that says we didn’t know about it so we aren’t responsible for it and they claim that’s what their insurance policy says.what then? Because that was the city of dyersburg a position on damaged cars in a previous article

  • Mr. Mullins is probably btw 70-80 yrs old. He use to be a Constable… not sure if he still is. 25 yrs ago he was remodeling homes, he did my fathers house after a fire. Completely half aaa did it & wouldn’t fix anything, not to mention how ugly he was about it. So I can definitely see him turning a blind eye or saying he “wasn’t aware”.

  • Tht's exactly what my attn went to! Lol.

    Waffle house... heck yeah! Heehee

    And the city does not own tht area. That lil road tht wraps around the mall & the mall are all owned by tht place in MO. They are responsible for tht entire area, not the city of Dyersburg. And this has been a battle for years now - with the city trying to contact tht company & make em get tht area fixed but apparently they think they can just keep ignoring the city's requests. We'll see what happens next, I guess.
